Terms of Service

1. Acceptance of these terms

By installing or using Cram, you confirm that you can form a binding contract with us and that you accept these Terms and our Privacy Policy. If you use Cram on behalf of someone else (for example, a child you're responsible for), you do so subject to these Terms.

2. What Cram is

Cram is a study app that turns material you provide — a topic, pasted text, a web link, or a PDF — into AI-generated flashcards, and helps you review them with spaced repetition. Cram is a study aid, not a source of professional advice.

3. Eligibility and age

You must be at least 13 years old to use Cram. If you are between 13 and 17 (or under the age of digital consent in your country), you may use Cram only with the permission of a parent or guardian who agrees to these Terms on your behalf and is responsible for your use.

4. Licence to use Cram

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Cram for your own studying, subject to these Terms and to Apple's standard Licensed Application End User License Agreement (the “Apple EULA”). You may not sell, sublicense, or commercially exploit the App.

5. Subscriptions, billing, and cancellation

Cram is free to download. Some features require a paid Cram Pro subscription. The following applies to subscriptions purchased through the App:

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• Manage or cancel your subscription anytime in your Apple account settings. Deleting the App does not cancel a subscription.
• Prices may change; we'll give reasonable notice and any change applies to future billing periods.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Refunds are handled by Apple under App Store policy.

6. Your content and ownership

You keep ownership of the material you put into Cram and the decks you create. You're responsible for having the right to use any content you submit.

Cram is offline-first: your decks are stored on your device, not uploaded to our servers. The only processing we perform on your content is to transiently send your input to our AI providers to generate your cards (see section 7 and our Privacy Policy). We do not claim ownership of your content, we do not sell it, and we do not use it to train AI models.

7. AI-generated content

Cram uses artificial intelligence to generate flashcards from the material you provide. AI can produce content that is inaccurate, incomplete, biased, or misleading.

You are responsible for reviewing the cards Cram generates. Do not rely on Cram for medical, legal, financial, or other professional advice, and always verify important facts against authoritative sources. To the extent you have rights in the generated cards, those cards are yours to use for your studying.

8. Acceptable use

When using Cram, you agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Submit content you don't have the right to use, or that infringes the rights of others.
• Upload content that is illegal, harmful, hateful, harassing, or that exploits minors.
• Use Cram to generate content for deception, academic dishonesty in breach of your institution's rules, or other harmful purposes.
• Attempt to disrupt, overload, reverse-engineer, or circumvent the App or the third-party services it relies on.
• Use automated means to access the App or to abuse the AI generation features.
• Resell, sublicense, or commercially exploit the App or its output without our permission.

9. Our intellectual property

Cram — including its name, logo, design, and software — is owned by Sunbranch AS and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or brand. All rights not expressly granted to you are reserved.

10. Copyright concerns

We respect intellectual-property rights. If you believe content generated or used within Cram infringes your copyright, email support@cramaiapp.com with a description of the work, the allegedly infringing material, and your contact details, and we'll review and respond. We may remove infringing material and restrict users who repeatedly infringe.

11. Disclaimers

CRAM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the App will be uninterrupted or error-free, or that AI-generated content — including our models and their output — will be accurate, complete, or reliable.

12. Limitation of liability

To the fullest extent permitted by law, Sunbranch AS will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data or study progress, arising from your use of Cram. Our total liability for any claim is limited to the greater of (a) the amount you paid for Cram in the 12 months before the claim, or (b) NOK 500.

Nothing in these Terms limits liability that cannot be limited by law, and your mandatory statutory rights as a consumer are not affected.

13. Termination

You may stop using Cram at any time by deleting the App. We may suspend or end your access if you breach these Terms. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

14. Changes to the App and these Terms

We may update the App and these Terms from time to time. If we make material changes, we'll update the “last updated” date above and, where appropriate, notify you in the App. Continuing to use Cram after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Norway, without regard to its conflict-of-laws rules. If you are a consumer, you benefit from any mandatory provisions of the law of your country of residence, and you may be able to bring proceedings there.

16. Apple's terms

Because Cram is distributed through the App Store, Apple's Licensed Application End User License Agreement also applies to your use of the App. These Terms are between you and us, not Apple, and Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
